Terms of Service

These Terms of Service ("Terms") govern your access to and use of Toriva (the "Service"), an AI-powered platform for creating real estate videos and related media. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use Toriva. You are responsible for the activity under your account and for keeping your login credentials secure. Notify us promptly of any unauthorized use.

2. Your content

"Your Content" means the photos, footage, text, logos, and other materials you upload or generate using the Service. You retain ownership of Your Content. You grant Toriva a worldwide, non-exclusive license to host, process, reproduce, and modify Your Content solely to operate and provide the Service to you, including generating videos, staging, voiceovers, and other outputs you request.

You represent that you own or have the necessary rights to all of Your Content and that its use by Toriva will not infringe the rights of any third party. You are solely responsible for having the rights to any property, person, brand, or likeness depicted in Your Content.

3. AI-generated output

The Service uses third-party AI models to generate and enhance media. Outputs are produced automatically and may contain inaccuracies or artifacts. You are responsible for reviewing every output before publishing or sharing it, and for ensuring it complies with applicable real estate advertising and disclosure rules. Toriva does not guarantee that outputs are accurate, fit for a particular purpose, or free of defects.

4. Acceptable use

You agree not to use the Service to:

• Upload content you do not have the right to use, or that is unlawful, infringing, or deceptive.
• Create content that misrepresents a property in a way intended to mislead buyers or violate fair-housing laws.
• Generate content depicting a real person without their consent, or that is defamatory, harassing, or harmful.
• Reverse engineer, scrape, or attempt to disrupt or gain unauthorized access to the Service.
• Resell or redistribute the Service except as expressly permitted.

5. Plans, credits & billing

Paid plans and one-time credit packs are billed through our payment processor. Credits are consumed when you generate media, as described on our pricing page, and are non-refundable except where required by law. Subscriptions renew automatically until cancelled; you may cancel at any time and your plan will remain active through the end of the current billing period. We may change prices on a going-forward basis with reasonable notice.

6. Intellectual property

The Service, including its software, design, and trademarks, is owned by Toriva and protected by intellectual property laws. These Terms grant you no rights to our brand or technology except the limited right to use the Service. Subject to your compliance with these Terms and payment of applicable fees, you may use the videos you create for your own commercial and marketing purposes.

7. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends, and we may delete Your Content after a reasonable period.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Toriva will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to us in the twelve months before the event giving rise to the claim.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the date above and, where appropriate, by additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
